About Us V1 Img

Our Philosophy

South Bay Law Firm was founded on two primary principles:

  • Insolvency– an unfortunate reality of business and municipal “life cycles” – is a complex economic process that can nevertheless be managed, mitigated, and even turned to advantage.
  • Within that process, the role of counsel must be to achieve value by minimizing loss, maximizing recovery, or realigning capital structure.

South Bay Law Firm’s value proposition is simple:  provide clients with

  • technical expertise grounded in decades of experience
  • practical insight driven by strong business acumen
  • relentless focus required to minimize loss, maximize recovery, or realign capital.

Our Results

Some recent results for recent clients:

  • Trade creditors: Defended numerous preference “claw-back” actions, reducing creditors’ liability by 60% – 96%.
  • Lessors:  Negotiated structured dismissal of Chapter 11 case for landlord, facilitating landlord’s sale of commercial property.
  • Prosecuted competing plan of reorganization in Chapter 11 case, resulting in a projected 40% recovery for landlord.
  • Investors:  Negotiated investors’ successful promissory note sales in debtor’s out-of-court corporate restructuring.
  • Debtors: Reorganized small business debtors, twice confirming Chapter 11 plans that returned 100% to creditors.
  • Negotiated debtor’s out-of-court conveyance of assets to lender through “Article 9” foreclosure.
  • Bankruptcy trustees:  Analyzed and cash-traced multiple fraudulent transfers of real and personal property, resulting in partial summary judgment for bankruptcy trustee.
